1. Scope
These Terms govern the use of "fabricgate", an FPGA design registry operated by the fabricgate operator (the "Operator"): the website at fabricgate.dev, the API at registry.fabricgate.dev, and the published command-line tool and SDK (together, the "Service"). By using the Service you agree to these Terms.
2. Accounts
- Accounts are created by signing in through an external identity provider such as GitHub. Authentication is handled by Auth0.
- You are responsible for your account, sessions and API keys. Revoke an API key immediately if you suspect it has leaked.
- The Operator may suspend or delete an account for a breach of these Terms, abuse, or a legal requirement.
3. Namespaces
- Designs are published under a namespace. You create namespaces and may add members.
- Reserved names (vendor and product names, among others) cannot be created by general users. A legitimate rights holder can obtain such a namespace free of charge after verification through an official-domain email address or a DNS record.
- Namespace names are public; memberships are visible only to the namespace's admins.
4. Publishing content
For every design, binary, metadata and README you publish (the "Content"), you warrant that:
- you have the right to distribute it;
- the license declared in the manifest (SPDX identifier) is accurate and matches the actual terms of the Content;
- it does not include vendor material whose redistribution is not permitted (tool samples, evaluation binaries and the like);
- it does not include malware, binaries intended to damage devices, or anything unlawful;
- publishing it does not violate applicable export-control law (Japan's Foreign Exchange and Foreign Trade Act, the U.S. EAR and others).
An index-only entry places only a link and metadata for something published on an external site. The Service does not host a copy of that binary, and the publisher's license applies. The Service is not affiliated with the publisher or with any device vendor.
5. What users receive
Published Content can be viewed and downloaded by anyone. The terms of use of each item are the license its publisher declared. The Operator grants no license of its own and does not review Content for accuracy or safety.
6. Operator action (takedown)
- On notice of infringement, malware, dangerous binaries or other Content contrary to these Terms, or on becoming aware of it, the Operator may yank the version, suspend the namespace or remove the Content.
- Send infringement notices to
abuse@fabricgate.devwith the rights holder's (or agent's) contact details, the target (namespace / design / version), the nature and basis of the claim, and a statement that the notice is accurate. Notices are handled as notices under 17 U.S.C. § 512. Counter-notices from publishers are accepted at the same address. - Requests under Japanese law for measures to prevent transmission are accepted at the same address.
- Metadata of a yanked version may remain visible so that existing users are warned.
7. Prohibited conduct
- Unauthorized access to the Service or to other users' accounts; circumventing rate limits.
- Impersonating another party's namespace or an official distribution channel.
- Imposing load that interferes with the operation of the Service.
- Publishing Content contrary to Section 4.
8. Free of charge, no warranty
The Service is provided as is and free of charge. The Operator makes no warranty of availability, continuity, preservation of Content or fitness for a particular purpose. The Operator keeps backups but does not guarantee restoration. The Service may change or be discontinued without notice.
9. Limitation of liability
Except where caused by the Operator's wilful misconduct or gross negligence, the Operator is not liable for damage arising from use of, or inability to use, the Service. This Section does not apply to the extent it is restricted by the Consumer Contract Act of Japan or other mandatory law.
10. Changes to these Terms
The Operator may change these Terms. A revised version takes effect when it is posted on this page. The history of changes is kept in the Service's source control.
11. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over disputes concerning the Service.
12. Language
These Terms are written in Japanese, and the Japanese text is the binding version. This English text is a reference translation; the Japanese text prevails in case of discrepancy.
